1. Your referral and report

a. By completing the referral form and paying, you (or those whom you are acting for as a servant or agent) are creating contract with Every Medical Ltd, company number 12878612 (trading as FirearmsMedicals) hereinafter referred to as FM; for firearms or shotgun licence medical report verification.

b. You must complete the referral form fully and accurately to initiate a referral to FM.

c. All referral forms must be completed online using our referral portal or on paper by completing our referral paperwork.

d. When completing your referral, you accept that FirearmsMedicals may take up to 33 days to complete your report. This is usually much sooner, but your GP surgery can take up to 30 days to send your medical records (or longer if they post them to us).

e. You accept that your referral will be allocated to a member of our panel of doctors. We will ensure that the doctor is suitably qualified and indemnified and you can check that they are qualified by searching their name on the GMC register.

f. We aim to complete your report and return it to you within 3 working days from the time of receipt of medical records from your GP surgery. You accept that reports may be completed and returned to you sooner or in some cases after 3 working days. We reserve the right to begin the ‘3 working day turnaround’ aim in cases where referrals are incomplete or your GP surgery do not comply with our request for medical records.

g. By submitting your referral you understand that the process involves a medical professional reviewing your full medical records to assist the police in determining whether you currently or previously have had any of the following medical conditions:
• An acute stress reaction or an acute reaction to stress caused by trauma
• Depression or anxiety
• Suicidal, intention, thoughts or self-harm.
• A history or diagnosis of dementia
• Mania, bipolar disorder or a psychotic disorder
• Personality disorders
• Neurological conditions: e.g. example Multiple Sclerosis, Parkinson’s or Huntington’s disease, or Epilepsy
• Any alcohol or drug abuse
• Other mental or physical conditions which might affect the safe possession of a shotgun or firearm

This information will then be shared with you and or the necessary police force (this varies force by force) responsible for the granting or renewal of your licence.

h. As per 2019 Home Office guidance we will also write to your GP surgery to advise that the police may contact them to request a firearms marker is added to your patient record (if such a marker is not already present on your patient record) to enable the GP to flag up to police any new medical issues which emerge following the grant of the certificate.

2. Cancellations

a. If you wish to cancel the referral you have made you must email [email protected] (Our opening times are Mon-Fri, 8.30-17.00 exc. Bank Holidays).

b. Any referral cancelled prior to one of our GPs being allocated your referral and subsequently completing your medical report, will result in a full refund.

c. Despite our aim to complete your report and return it to you or your designated firearms officer within 3 working days once medical records are received, we often complete reports much faster. You unequivocally accept that you cannot cancel your referral to FM if a doctor has been allocated your referral and subsequently has commenced completing your medical report, or if the completed report has been returned to you or your designated firearms officer.

d. If FM is unable to carry out a medical report for whatever reason, you unequivocally accept that FM’s liability shall be limited to no more than the fee which you paid for the medical report. FM shall not be responsible for any consequential loss.

3. Payment

a) Payment for all referrals submitted online at https://firearmsmedicals.co.uk, or for referrals submitted by post or email will be taken via debit or credit card once your referral has been submitted.

b) For the avoidance of doubt, payment is taken before your referral is allocated to one of our panel GPs.

c) Receipts can be provided by email at your request.

4. Your obligations and responsibilities

a. You must co-operate with us in all matters relating to the service.

b. It is your responsibility to ensure that the referral made is appropriate to your requirements.

c. Although precautions have been taken by FirearmsMedicals, it is ultimately your responsibility to ensure that the relevant police force will accept a medical report completed by a doctor other than your own GP.

d. It is your responsibility to ensure that referral form is accurate and complete. Any information which is missed from the referral form which is later required to be incorporated into the medical report may incur additional charges at our discretion.

e. As you are self-referring you are responsible for the content and accuracy of the referral form. Be aware that your medical report will be viewed by the relevant police force and any inaccurate information or personal comments about you as a result of incorrect information being recorded on your referral form will be shared with the police.

f. Being responsible for the content of the referral form you are indemnifying FM against any complaint or claim arising from inaccurate or false information contained therein.

g. You must not, under any circumstance, contact or attempt to contact our GPs or any of our medical staff directly, with a view to arranging a medical assessment or procuring services from them. All referrals and enquires must be made to https://firearmsmedicals.co.uk or [email protected].

h. You must not, under any circumstance, use our company logo or any other associated images or trademarks of Every Medical Ltd without prior authorisation from us.

5. Our obligations and responsibilities

a. We will ensure that all our clinicians hold the appropriate professional registration with GMC and insurance/indemnity.

b. We will ensure that all our clinicians are selectively recruited and trained in order to ensure a reasonable standard of service is provided.

c. If the clinician identifies that any medical records are missing, we will notify you of this at the earliest opportunity.

d. We will confirm all referrals received by email and keep you up to date with the progress of your referral and medical report.

e. If for any reason we need to cancel an instruction/referral, we will notify you of this as soon as possible. We will use our reasonable endeavours to ensure that your referral goes ahead and in cases where this is not possible you will be entitled to a full refund. We shall not refund or be liable for any cancelled referrals if our doctor has already began completing your medical report, or has completed your medical report and it has been sent to you or your designated firearms officer.

6. Delays outside of our control

a) We are not responsible for delays outside our control. If the provision of our services is delayed by an event outside our control (such as your GP surgery delaying the release of your medical records) then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any services you have paid for but not received.

7. Price and payment

a) The price of the medical examination (which includes VAT) will be the price indicated on our website https://firearmsmedicals.co.uk.

b) When you must pay and how you must pay: We accept payment with credit or debit card including Visa, Mastercard or Maestro. We do not accept American Express. You must pay us in advance the full price of the medical report before our GP commences in completing your medical report.

8. Our responsibility for loss or damage suffered by you

a) We are not liable for businesses losses. If you use our services for any commercial or business purpose we will have no liability to you or any loss of profit, loss of business, business interruption, or loss of business opportunity.

9. How we may use your personal information

a) We will only use your personal information as set out in our privacy policy: https://firearmsmedicals.co.uk/privacy-policy/.

10. Other important terms

a) We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

b) Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.

c) If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

d) Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date

e) Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts
